Terms of Service

These Terms of Service ("Terms") govern your use of PODBULK at app.podbulk.com (the "Service"), operated by Scanfastly LLC, a Wyoming, United States limited liability company ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PODBULK is a tool that generates bulk product mockups from your PSD templates and design images. Rendering happens inside your own browser using an embedded engine. We provide the application, your account, and your subscription plan.

2. Accounts

You log in using a one-time link sent to your email address. You are responsible for maintaining access to your email account and for all activity under your account. You must provide accurate information and be at least the age of majority in your jurisdiction (or have permission from a parent or guardian).

3. Plans, billing, and renewals

• We offer a free tier and paid subscription plans. Plan features and limits are described on our pricing page and may change over time.
• Paid plans are billed in advance on a recurring basis (monthly) through our payment processor, Stripe, until cancelled.
• By subscribing, you authorize us, through Stripe, to charge your payment method on each billing cycle.
• Plan limits (for example, the number of mockups per month) reset each billing period. Unused allowance does not carry over unless explicitly stated.

4. Cancellation and refunds

You can cancel your subscription at any time from your account (via the billing portal). When you cancel, your plan remains active until the end of the current billing period, after which it will not renew.

All payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused allowance, or for periods in which you did not use the Service. Because you can cancel at any time to prevent future charges, please cancel before your next billing date if you do not wish to be charged again. This does not affect any rights you may have under applicable mandatory law. See our Refund Policy for details.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to infringe anyone's intellectual property or other rights;
• Generate mockups using designs or templates you do not have the right to use;
• Attempt to bypass plan limits, security measures, or authentication;
• Reverse engineer, resell, or redistribute the Service except as permitted;
• Interfere with or disrupt the Service or the servers and networks it runs on.

6. Your content and intellectual property

You retain all rights to your PSD templates, design images, and the mockups you generate. Because these files are processed in your browser and never stored on our servers, we do not claim any rights over them. You are solely responsible for ensuring you have the rights to the files you use.

The Service itself, including its software, design, and branding, is owned by Scanfastly LLC and protected by law. These Terms do not grant you any ownership of the Service.

7. Third-party components

The Service uses third-party components, including the Photopea rendering engine (used with permission for commercial use) and Stripe for payments. Your use of those components may also be subject to their respective terms.

8. Service availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Rendering speed depends on your own device and the complexity of your files.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that results will be uninterrupted, accurate, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Scanfastly LLC and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.

11. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, other users, or third parties.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Any disputes shall be subject to the courts located in Wyoming, unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
